  1. Scope

2.1. These General Terms and Conditions (" Terms and Conditions ") regulate the use of the online store (" Online Store ") of Butiah (" Butiah "), hereinafter referred to as the " Seller ".

2.2. The Online Store is intended for the sale of natural wicker furniture and decoration, handmade, made to measure and personalized (" Products ").

2.3. The purchase of Products through the Online Store implies full and unreserved acceptance of these Terms and Conditions by the Customer (" Customer ").

  1. Registration and Customer Account

3.1. The Customer may browse the Online Store without the need to register. However, in order to make a purchase, the Customer must create a Customer account (" Customer Account ").

3.2. Creating a Customer Account involves filling out a form with the following data:

  • Full name;
  • Email address;
  • Password;
  • Billing address;
  • Delivery address.

3.3. The Customer undertakes to provide true, complete and up-to-date data when creating the Customer Account and to keep it updated.

3.4. The Customer is responsible for the confidentiality of his/her password and for all acts carried out through his/her Customer Account.

3.5. The Seller reserves the right to block or cancel a Customer Account if it detects any fraudulent or abusive activity.

  1. Products and Prices

4.1. The characteristics of the Products, including their measurements, materials and finishes, are described in the Online Store.

4.2. All prices include VAT at the legal rate in force in Portugal.

4.3. The Seller reserves the right to change the prices of the Products at any time. However, such changes do not apply to orders already paid for by the Customer.

4.4. The Products are handmade, custom-made and personalized, so they may present slight differences in relation to the images presented in the Online Store.

4.5 . The seller is not responsible for any changes that the screens of electronic devices, such as resolution, brightness or luminosity, may cause to the images.

  1. Orders

5.1. To place an order, the Customer must select the Products they wish to purchase, add them to the shopping cart and follow the steps indicated in the checkout process.

5.2. During the checkout process, the Customer must provide the following data:

  • Full name;
  • Billing address;
  • Delivery address;
  • Payment method.

5.3. The Customer may choose between the following payment methods:

  • Credit card;
  • Bank transfer;

5.4. The Seller's order confirmation will be sent by email to the Customer's email address.

5.5. The Seller reserves the right to cancel an order in the event of:

  • Error in payment data;
  • Suspected fraud.

  1. Delivery

6.1. Delivery of the Products is made to the delivery address indicated by the Customer during the checkout process.

6.2. The delivery period for the Products is up to 20 working days after confirmation of the order by the Seller.

6.3. The cost of delivery of the Products is borne by the Customer, in accordance with the value of the order and the delivery address.

6.4. The Customer will be notified by email when their order is shipped.

6.5. Delivery of the Products is considered to have taken place at the time they are delivered to the Customer or to a third party indicated by the Customer.

6.6. The Customer must check the condition of the Products upon delivery. In the event of any anomalies, the Customer must contact the Seller immediately.

  1. Exclusion of the Right to Free Resolution

7.1. Butiah offers handcrafted products in natural wicker, customized according to customer specifications, including dimensions and finishes.

7.2 In accordance with Decree-Law No. 24/2014, of February 14, the right to free resolution does not apply to personalized products, which are produced to measure and according to the Customer's specific preferences.

7.3. When placing an order with Butiah, the customer accepts that the product is custom-made, based on specific preferences (such as size and finishes), and that it is not reusable or sellable to other consumers.

7.4. Therefore, under the terms of article 17, paragraph c), of the aforementioned Decree-Law, personalized or custom-made products are excluded from the right to return and exchange, except in cases of manufacturing defect or non-compliance with the order.

7.5. If the customer finds any defect or non-conformity in the delivery of the product, he/she must inform Butiah within 14 days of receipt, so that the necessary corrective measures can be assessed and implemented.

  1. Guarantees

8.1. The Products are covered by the legal guarantee of conformity provided for in Portuguese law.

8.2. The legal guarantee of conformity lasts for 3 (three) years from the date of delivery of the Products.

8.3. During the warranty period, the Customer is entitled to free repair or replacement of Products that prove to be defective, except in cases of misuse or handling by the Customer.

8.4. To exercise his/her right to the guarantee, the Customer must contact the Seller using the contact details provided in the Online Store.

  1. Dispute Resolution

9.1. These General Conditions are governed by Portuguese law. Any dispute arising from or related to these General Conditions shall always be settled by the Portuguese courts. The customer may also obtain information about their rights from the competent alternative consumer dispute resolution bodies, available at www.consumidor.pt .

9.2. Butiah hereby warns that it does not have a policy of adhering to arbitrations facilitated by those entities, verifying, on a case-by-case basis, the best alternative for resolving the dispute in question, always taking into account the best interests and rights of its clients.

  1. Intellectual Property

10.1. All contents of the Online Store, including, but not limited to, texts, images, videos, brands and logos, are protected by copyright and intellectual property rights of the Seller or their legitimate owners.

10.2. The Customer is not authorized to use, copy, reproduce, modify, distribute or disclose the contents of the Online Store without the prior written authorization of the Seller.

  1. Privacy

11.1. The Seller respects the Customer's privacy and undertakes to protect their personal data in accordance with the provisions of current legislation.

11.2. The processing of the Customer's personal data by the Seller is governed by the Privacy Policy available in the Online Store.

  1. Responsibility

12.1. The Seller is not liable for any damages or losses that may arise from the use of the Online Store, including, but not limited to, damages or losses caused by errors, omissions, interruptions, viruses or system failures.

  1. Force Majeure

13.1. The Seller shall not be liable for any failure to comply with its contractual obligations in the event of a case of force majeure, such as natural disasters, wars, strikes or riots.

  1. Communications

14.1. All communications between the Seller and the Customer must be made in writing, through the Online Store or to the contacts indicated therein.

  1. Proof

15.1. The Seller's computer records shall be considered sufficient evidence for the purpose of demonstrating the facts and circumstances relating to the Customer's use of the Online Store.

  1. Resignation

16.1. The waiver by the Seller of any right under these Terms and Conditions does not constitute a waiver of any other right or right.

  1. Change of Terms and Conditions

17.1. The Seller reserves the right to change these Terms and Conditions at any time.

17.2. Changes to the Terms and Conditions will be communicated to the Customer through the Online Store.

  1. Final Provisions

18.1. If any provision of these Terms and Conditions is held to be invalid or unenforceable, this shall not affect the validity and enforceability of the remaining provisions.

18.2. These Terms and Conditions constitute the entire agreement between the Seller and the Customer with regard to the sale of the Products through the Online Store.

By using the Online Store, the Customer declares that he/she has read and accepted these Terms and Conditions.
